License Agreement and Terms of Use

This agreement is between CBN Teknoloji Anonim Şirketi (the “Provider”) and the business that installs the ChatPilot (WhatsApp, Telegram) application (the “Application”) on its Bitrix24 portal (the “Customer”). By installing or using the Application you accept these terms.

1. Service

The Application connects the Customer's WhatsApp numbers to Bitrix24 Open Channels and provides message delivery, statistics, reporting and notifications. The Application depends on the Bitrix24 and WhatsApp services; the Provider is not responsible for outages or changes in those services.

2. Trial and fees

• A 4-day free trial starts automatically on first installation.
• After the trial, the Application is licensed per connection through a credit system. Credit packs are purchased in the app's Payment tab; connections are activated with credits for 7 days, 1, 3, 6 or 12 months. Purchased credits do not expire. Unused credits are refunded on request, based on the amount paid per credit; credits already used to activate connections and bonus or gift credits are not refundable. Refund requests go to info@chatpilot.com.tr. Current pack and credit prices are published at chatpilot.com.tr/en#pricing (taxes excluded).
• When a number's license expires, message delivery for that number stops.
• Credits used to activate a connection are non-refundable, except for service outages caused by the Provider that cannot be remedied.

3. Customer obligations

• Comply with the WhatsApp Terms of Service and WhatsApp Business Policy; do not send bulk, unsolicited or unlawful messages.
• Process the personal data of the people it communicates with in accordance with applicable law and obtain the required notices and consents.
• Connect only WhatsApp numbers it owns or is authorized to use.

4. Risks and limitation of liability

The QR-code connection method is not WhatsApp's official business API; numbers may be restricted or banned if WhatsApp rules are violated. The Provider's total liability is limited to the fees paid by the Customer in the 3 months preceding the event. The Provider is not liable for indirect damages, loss of profit or loss of data.

5. Termination

The Customer may terminate this agreement at any time by uninstalling the Application from Bitrix24. The Provider may suspend the service in case of a breach of this agreement.

6. Changes

The Provider may change these terms and prices; changes are announced in the Application at least 30 days in advance.

7. Governing law

This agreement is governed by the laws of the Republic of Turkey; the courts and enforcement offices of Istanbul Anatolian have jurisdiction.
